Terms of Service

1. Acceptance and eligibility

By accessing or using a ZIAM service, you agree to these Terms and any product-specific terms presented before purchase, registration, download, or participation. If you do not agree, do not use the relevant service.

You must have legal capacity to enter the applicable agreement. Where a user is below the age of legal capacity, a parent or guardian must provide any consent required by law and supervise use of the service.

2. Accounts and security

You must provide accurate account information, protect authentication credentials, and notify ZIAM promptly about suspected unauthorised access. You are responsible for activity conducted through your account unless applicable law provides otherwise.

ZIAM may require identity or transaction verification where reasonably necessary for security, fraud prevention, legal compliance, or recovery of an account.

3. Acceptable use

You may use ZIAM services only for lawful purposes and in a way that respects other users, systems, and rights.

• Do not attempt unauthorised access, bypass security controls, disrupt service availability, or distribute malicious code.
• Do not use a service for fraud, impersonation, harassment, unlawful surveillance, infringement, or deceptive activity.
• Do not scrape, overload, reverse engineer, or automate access except where the service, licence, or written permission allows it.
• Do not upload content you do not have the right to use or content that violates applicable law.

4. Content and intellectual property

ZIAM and its licensors retain rights in the ZIAM name, branding, interfaces, software, documentation, designs, and original content. Access to a service grants a limited, revocable, non-transferable right to use that service under these Terms; it does not transfer ownership.

You retain ownership of content you submit. You grant ZIAM the limited rights necessary to host, process, display, secure, and deliver that content for the requested service. Product-specific terms may describe additional rights for collaborative, research, or public contributions.

5. Purchases, subscriptions, and delivery

Prices, taxes, payment schedules, renewal terms, cancellation rules, delivery estimates, and refund rights will be displayed before a binding purchase. Product-specific terms control where they conflict with this general section.

ZIAM will not use an unfair term or representation to remove a non-excludable consumer right under applicable Kenyan law.

6. Availability and changes

ZIAM may improve, add, suspend, or discontinue features for security, legal, operational, or product reasons. Reasonable notice will be provided where a material change affects a paid continuing service, unless urgent action is required.

Beta, preview, and research services may be incomplete, change frequently, or be withdrawn. Their status will be identified where relevant.

7. Responsibility and limitations

ZIAM will provide services with reasonable care and skill. To the extent permitted by law, services are otherwise provided on an as-available basis and no guarantee is made that every service will be uninterrupted or error-free.

Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded. Any other limitation will be interpreted only to the maximum extent permitted by applicable law and the relevant product agreement.

8. Suspension and termination

Access may be restricted or terminated where reasonably necessary to address serious misuse, non-payment, security risk, legal obligations, or material breach. Where appropriate, ZIAM will explain the reason and provide a route to review or remedy.

9. Governing law and disputes

These Terms are governed by the laws of Kenya, without removing any mandatory protection available under another applicable law. The parties should first attempt good-faith resolution through the ZIAM Help Center before pursuing another lawful dispute process.

10. Updates to these Terms

ZIAM may update these Terms to reflect service, legal, security, or operational changes. The effective date will be updated, and material changes affecting an active account or paid service will be communicated through an appropriate channel.
